elementor - v3.21.0 - 25-04-2024 *\/\n.elementor-widget-text-editor.elementor-drop-cap-view-stacked .elementor-drop-cap{background-color:#69727d;color:#fff}.elementor-widget-text-editor.elementor-drop-cap-view-framed .elementor-drop-cap{color:#69727d;border:3px solid;background-color:transparent}.elementor-widget-text-editor:not(.elementor-drop-cap-view-default) .elementor-drop-cap{margin-top:8px}.elementor-widget-text-editor:not(.elementor-drop-cap-view-default) .elementor-drop-cap-letter{width:1em;height:1em}.elementor-widget-text-editor .elementor-drop-cap{float:left;text-align:center;line-height:1;font-size:50px}.elementor-widget-text-editor .elementor-drop-cap-letter{display:inline-block}<\/style>\t\t\t\t<div class=\"wrapper container-fluid\">\n<div class=\"static-page-content\">\n<section id=\"propiedad-intelectual\" class=\"patch_a2 patch_a2_hentry\">\n<p>En nuestro compromiso por el respeto y protecci\u00f3n de los derechos de propiedad intelectual tanto de nuestros proveedores como de terceros, hemos implementado este nuevo espacio para que se puedan reportar productos que se venden a trav\u00e9s de nuestra p\u00e1gina y que usted considera est\u00e1n infringiendo derechos Propiedad Intelectual legalmente protegidos.<\/p>\n<h4>\u00bfCu\u00e1l es el objetivo?<\/h4>\n<p>Esta iniciativa tiene por objeto permitir a los titulares de derechos de propiedad intelectual (derechos de autor, marcas, patentes, entre otros) que notifiquen a Jam food service si creen que sus derechos est\u00e1n siendo vulnerados por la venta de alg\u00fan o algunos de los productos que se ofrecen en el portal.<\/p>\n<p>De este modo, Jam food&nbsp; service&nbsp; proceder\u00e1 a estudiar cada caso para determinar si los productos deben ser bajados del portal por no contar con las autorizaciones que se requieren, o si por el contrario no se est\u00e1n infringiendo derechos de terceros.<\/p>\n<h4>\u00bfQui\u00e9nes pueden presentar estos reclamos?<\/h4>\n<p>Cualquier persona natural o jur\u00eddica que sea titular de un derecho de propiedad intelectual podr\u00e1 presentar el reclamo cuando considere que con la venta de alg\u00fan producto ofrecido por medio de nuestra p\u00e1gina, se le est\u00e1 vulnerando un derecho.<\/p>\n<p>En el caso de personas jur\u00eddicas, este reclamo deber\u00e1 ser presentado por su representante legal o quien est\u00e9 autorice mediante documento escrito.<\/p>\n<h4>\u00bfC\u00f3mo se realiza el reclamo?<\/h4>\n<p>Para poder realizar el reclamo, se deber\u00e1 acreditar ante Linio la titularidad de los Derechos de Propiedad Intelectual que se presumen vulnerados.<\/p>\n<p>Con el fin de corroborar lo anterior, se deber\u00e1 enviar una copia de los siguientes documentos al correo: servicioalcliente@jamfoodservice.com<\/p>\n<p>debidamente diligenciado y firmado por el titular de los Derechos de Propiedad Intelectual o por su representante legal. Para el diligenciamiento del formulario, se deber\u00e1 enunciar cu\u00e1les son los productos o publicaciones que presuntamente vulneran los derechos.<\/p>\n<p>Autorizaci\u00f3n del titular de los derechos, en caso que la persona que interponga el reclamo no sea el titular.<\/p>\n<p>Documentos que acrediten la titularidad de los Derechos de Propiedad Intelectual, que hayan sido registrados en el pa\u00eds en el cual se presente la supuesta infracci\u00f3n.<\/p>\n<p>No se tendr\u00e1n en cuenta constancias de tr\u00e1mites de inscripci\u00f3n en curso.<\/p>\n<p>Una vez recibamos la reclamaci\u00f3n, procederemos a dar tr\u00e1mite a la investigaci\u00f3n Revisaremos los documentos aportados y solicitaremos a quien comercializa los productos objeto de la presunta infracci\u00f3n, que nos aporte las pruebas pertinentes para comprobar que no se est\u00e1n violando los derechos de propiedad Intelectual de terceros.<\/p>\n<p>En caso de no ser procedente la reclamaci\u00f3n, se enviar\u00e1 una carta al correo electr\u00f3nico, informando los motivos de esta decisi\u00f3n. Si por el contrario, Linio logra verificar que los productos y publicaciones infringen derechos de terceros, los eliminaremos de nuestra p\u00e1gina.<\/p>\n<h4>Inf\u00f3rmate antes de hacer la reclamaci\u00f3n<\/h4>\n<p>Creemos conveniente que antes de realizar la reclamaci\u00f3n leas la siguiente informaci\u00f3n que te ayudar\u00e1 a identificar algunos casos en los que no se est\u00e1 frente a una infracci\u00f3n.<\/p>\n<p>Los derechos de propiedad intelectual no son absolutos, y por ello tienen ciertas limitaciones en su ejercicio. Una de estas limitaciones se genera gracias a la figura del agotamiento, que implica que el derecho exclusivo que tiene el titular de uno de \u00e9stos derechos, termina en el momento en que \u00e9l introduce o permite que un tercero introduzca en el mercado sus productos.<\/p>\n<p>Siendo as\u00ed, una vez se realiza la primera comercializaci\u00f3n de un producto, \u00e9stos podr\u00e1n ser objeto de posteriores actos de comercializaci\u00f3n, como reventa, alquiler, pr\u00e9stamo u otras formas de uso comercial, sin que el titular original de los derechos pueda impedirlo.
